We have been living on rent in delhi at same place for about 4.5 years. We had provided security deposit for two months rent amount. Now, it's been 2.5 months we have vacated the premises and landlord was not returning security deposit. Yesterday, he agreed to return only one month amount stating that you need to pay for water and tear also.

A.Dear Sir,
It is very small issue and you have to settle the matter amicably. None of you can go to Court. You may agree for one month advance amount as return and close the matter since you have already handed over physical possession of the house.

A.Dear Client,
In the absence of any specific clause in the Rent agreement regarding payment of the cost of repairing normal wear and tear of the let-out premises, the landlord cannot demand the same from the tenant at the time of vacation of rental premises. Usually, the cost of normal wear and tear of the rented premises is borne by the landlord. To resolve the issue you need to file a complaint before the Rent Controller appointed under State-specific Rent Control Act.
