I have recently (November)a paid an Hyderabad based IT company known as Marolix technology to get an IT job,they promised to give the training for 6months and then after that based on performance people will be hired during those training period of 6months they said we will be getting a salary of 15k but it's been 2months not even a single rupee is received all they did create an bank account for us and conduct class every week days for half an hour then give task around it that's all, recently i get to know people who joined early in a similar way that I joined also not getting any some people who completed 6months no evaluation happened no class and nothing for them it's seems like around 800-1000 job seekers paid 2lakh each to this company still no response,so if you people know to do pls help us , THANK YOU

A.Dear client,

As an IT employee, you would come under the definition of workmen under Section 2 of the Industrial Dispute Act, 1947. As a workman, you can file a complaint against the company to your local labour commissioner. Subsequently, you along with the others aggrieved issue a legal notice to the company stating non payment would result in a labour suit.

Non-payment of salary would qualify as an unfair labour practice and you can initiate suit proceedings against the company. Section 33C of the Act deals with the recovery of money that is due to be paid to the employee. According to this provision, any employee or someone authorized by the employee, or legal heir in case of the deceased employee can file an application for payment of salary to the appropriate government. On being satisfied that such money is due, the appropriate government issues a certificate for payment of dues.
