Hi,

As my inlwas and husband blames me that I ask their property without any base or keeping false allegations on me without any evidence but all my husband parents property in the name of mother in law but she is not working profession she is house wife as I found his father is central government employee and his father in law father name is different from father in law siblings who has born with him but mother name is same for all and he couldn't able to get the death certificate of his non original father as i suspect, so he has joined govt job seeking false father name so in this case they are building 2 floor construction for about 40 lakhs at their house sending me out can I file case against all their property? If I file what will happen to all their property in mother in law name but not father in law as he background is forgery and also he was the only earning person in family?

A.Dear Client,
If you suspect that there is forgery or misrepresentation regarding your husband's family property, you may consider consulting with a lawyer to understand your legal options. In matters related to ancestral or joint family property, Hindu law plays a significant role. Depending on the specific circumstances, you may have a right to claim a share in the ancestral property. You could explore legal actions like filing a case for partition and claiming your rightful share. However, each case is unique, and the outcome may depend on various factors, including evidence and legal arguments presented. Consulting with a lawyer will help you understand the merits of your case and guide you on the appropriate legal steps based on the specific details you provide.
Thankyou

A.Dear Client,
If the property is self-acquired and registered in the name of your mother-in-law even if she is a housewife, nobody including a daughter-in-law cannot claim a share in the said property as a matter of right. As regards all other allegations, if you find yourself efficient in proving the allegations against your inlaws before the Court, then you may go ahead with the litigation, but in case you fail to prove your allegations, then you may be booked for making a false allegation/complaint and may face worse legal consequences.
