Cash given to dealer Cash given to dealer

I gave 100,000 RS to a dealer for deal of a residential plot.
Even after 45. Days no aggreement is done and I am doing follow up with dealer again again again. They are just saying tomorrow it will be done and same response.
Now he is not returning my token amount
I have a proof of his office partner in written explaining the total deal ,cash amount, white amount and all
Along with i have recording of the dealer partner about accepting that he as taken the amount and he is trying to get aggreement done ASAP.
What should I do?
Complaint to police for breach of trust and not returning money
Or should I send a notice to dealer and his partner and file a case against them?
Also am I eligible to get my expenses done on all legal work back from dealer through court in case I file a case in court?

A.send a legal notice to dealer and his partner and file a case against them if they doesn't return your money after 15 days from notice
You can get lil bit of legal expenses back from the dealer in case if you win the case, for that you are required to appoint a strong lawyer.

A.Dear Client,
In the absence of any documentary evidence supporting the transaction of money between you and the dealer, it is almost infeasible to get back your money legally from the dealer even through litigation. However, you can send a legal notice to the dealer demanding the refund of your money which may work or may not work. Litigation may not yield any relief to you in the matter, instead, it may drag the matter for a couple of months or years.
