My father passed away. He was a head master at a school of Rayat Shikshan Sanstha aided by state government of Maharashtra. He nominated his parents for the pension at the beginning of the service. My grandfather is also passed away 20 years ago. How can my mother can get the pension of my father

A.Dear Client,
In the event of inaction or rejection of the family pension application, your mother should submit a representation. If no resolution is achieved through this process, she can escalate the matter to the High Court to obtain a suitable order.

A.Dear Client,
As per the rules of the Employees’ Provident Fund (EPFO) Scheme, 1952, whatever nominations a member makes for EPF and EPS before marriage, becomes invalid after marriage. This means that after marriage, there is a need to do a fresh nomination again. Under the EPF Act, ‘Family’ in the case of a male member means the wife, children (whether married or not), dependent parents and the wife and children of the deceased son. If no nomination has been made under the EPF scheme, then the entire amount deposited in the fund will be divided equally among the family members. However, no share shall be payable to sons who have attained majority, married daughters whose husbands are alive. If the person is not married, the amount will be given to the dependent parents. In the case of EPS if the person is married, then the pension will be payable to his wife. So, in the given scenario, your mother has to approach the EPF Commissioner with all the relevant documents that support her claim for the disbursement of the pension of her deceased husband. Reach out to the Office of the Regional PF Commissioner to take appropriate steps in the matter.

A.Dear sir
Your mother has to file representation to get family pension if no action is taken or such application is rejected then approach high court and get appropriate order.
