My friend have been cheated with online fraud of 38000 and we have lodged a complaint with cyber rime department. They have assured of recovering money and transferring it back. However, we have not received anything even though we have contacted the bank and other places directed by them. Can you please advice on the process of recovering the money back?

A.Dear Client,

Upon reporting a cybercrime or fraudulent transaction on the National Cyber Crime Reporting Portal (NCCRP), the Cyber Crime Cell instructs the investigating team to initiate the standard investigation process. This involves promptly freezing the suspected accounts of fraudsters as well as the victim's bank account. The duration of the cybercrime investigation can vary, depending on factors such as case complexity, available resources, and victim cooperation.

Under Section 457 of the CrPC, a Magistrate is authorized to exercise discretion in ordering the conditional release of the frozen amount in a cyber scam case. In such instances, law enforcement may request an indemnity bond from the victim. The bond requires the victim to declare their commitment to repay the bank 1.5 times the refunded amount if their claim is found to be false or if other claims are made on the frozen amount.

Once a cybercrime scam or fraudulent transaction is reported online to the National Cyber Crime Reporting Portal(NCCRP), on the instruction of the Cyber Crime Cell, the investigating team starts the routine process of investigation immediately freezing the suspected accounts of fraudsters and the victim's Bank account and you have to wait for the completion of the investigation of the scam by the investigating agency. The length of time it takes to investigate a cybercrime can vary greatly depending on the complexity of the case, the resources available to the investigators, and the cooperation of the victim. Section 457 of the CrPC empowers a Magistrate to use their discretion to order the conditional release of the amount frozen under cyber scam. In this situation, the police seek an indemnity bond from the victim who needs to declare that he/she will pay 1. 5 times the refunded amount to the bank in case his/her claim is false or if other claims are made on the amount. If required, you may take the service of an Advocate for guidance and steps. You may also consult with a cyber crime expert for further guidance and steps.
