Abusive faculty behaviour with female PG medical students Abusive faculty behaviour with female PG medical students

One of my family members is doing her postgraduation in a private medical college. One of the doctors/faculty treats the female PG students without any respect. Uses abusive language and shouts badly in front of patients without valid reasons. Does not allow the PG students to sit in OPD for several hours each day. Does not allow time for having their meals. This is severly affecting both the physical and mental health of the students.

This has been known to happen from many years, but so far no one seems to have fought against it. The principal of the institution is also aware of it, but has not taken any actions. Infact, the principal is also known to be abusive towards female PGs. As parents and students, how can we fight against it legally?

A.Dear Client,

Addressing the unruly and abusive behavior of a single doctor/faculty member that affects the mental and emotional well-being of PG students is a serious matter. If the situation does not improve through internal channels, there are several steps that can be taken:

1. Mass Complaint to Head of Institution and Regulatory Authorities:
- PG students and their parents may collectively submit a mass complaint against the errant doctor to the head of the institution.
- A copy of the complaint can be endorsed to the regulatory authority, State Medical Council, and National Medical Council for their awareness.

2. Legal Notice and Criminal Suit:
- If the mass complaint does not yield improvement, consideration can be given to serving a legal notice to the head of the institution.
- Legal steps, including filing a criminal suit, can be explored under relevant sections of the Indian Penal Code (IPC) such as Sec. 503 (Criminal Intimidation), Sec. 268 (for public nuisance), and Sec. 500 (for defamation) to address the grievances of the students.

3. Complaint to Human Rights Commissions:
- A collective complaint can be made online to the National Human Rights Commission (NHRC) and State Human Rights Commission via their respective websites.
- Additionally, complaints can be directed to the National Commission for Women (NCW) and State Commission for Women, who have the authority to investigate issues related to women.
- Email communication to [email protected] or online filing of a complaint can be utilized.

4. Seeking Assistance from State Commission of Women and NGOs:
- PG students may approach the State Commission of Women in their state for assistance.
- NGOs dedicated to helping individuals in distress, especially women, can be contacted for support and guidance.

It's important to document instances of abusive behavior and maintain a record of the steps taken. Seeking legal advice from a professional may also be beneficial. Remember that the well-being and rights of the students should be prioritized throughout this process.

A.Dear Client,
Since the unruly and abusive behavior of one single doctor/faculty affects the mental and emotional parts of almost all the PG Students, it deserves a mass complaint against the errant doctor from the students as well as their parents to be made to the head of the Institution endorsing a copy of the said mass complaint to the regulatory authority, the State Medical Council and National Medical Council. If the mass complaint yields no improvement or development in the matter, then serving a legal notice to the head of the institution, steps may be taken for filing a criminal suit against the errant doctor and the head of the institution under Sec.503 of IPC (Criminal Intimidation), Sec.268 of IPC (for public nuisance) and also under Sec.500 of IPC (for defamation) to redress the mass grievance of the student. Additionally, you may collectively make a complaint online at (https://nhrc.nic.in/complaints/complaints/how-to-file-a-complaints) to the Chairperson, the National Human Rights Commission, New Delhi and the State Human Rights Commission along with the Chairperson, National Commission for Women and State Commission for Women who are empowered to investigate complaints related to issues faced by women anywhere by sending an email to [email protected] or filing an online complaint to resolve the issue in the right way. Further, you can also approach the State Commission of Women situated in your state, and seek help from the NGOs who rendered dedicated service to the women in distress. Reach out to Advocate for further guidance and steps.
