Rule 75 of the Railway Services (Pension) Rules, 1993, amended in 2016, provides the right to claim pension to one or more widows of a deceased employee, with the pension being distributed in equal shares among them.
The High Court of Karnataka has ruled that the Indian Railway's rules explicitly grant the right to a family pension of a deceased employee in equal proportions to more than one widow. In light of this rule, the court held that the second wife of the deceased employee is entitled to a share of the family pension, even if the second marriage is considered void under the provisions of the Hindu Marriage Act.
This ruling highlights the importance of the specific rules and regulations governing pension distribution in the context of government employment. It underscores that, in certain cases, even if a marriage is considered void under personal laws, the relevant employment rules may still grant entitlement to a share of the family pension to the legally wedded wives. Individuals seeking such benefits should refer to the specific rules applicable to their situation and, if needed, seek legal advice to understand their rights under these rules.
