Car accident case Car accident case

A person hit my car three weeks back and promised repair. So i didn't file a case. Every time we call he keeps on giving reasons like i am busy or i have work. I don't have any hope that he will repair.
Now I want to file a case.
Q1. Can I file a case after 3 or 4 weeks of accident.
Q2. Can i insist to repair the car only in showroom. Since initially he said he will repair in some mechanic shop.

What is the procedure and how to i go but this issue.

A.Dear Client,

In the event of a road accident, it is recommended to promptly report the incident to the police. While there isn't a strict time limit, filing a timely police report is crucial for documenting accident details and facilitating potential insurance claims. It is advisable to file a First Information Report (FIR) at the nearest police station as soon as possible, as delays may allow the accused to benefit from doubt and hinder the registration process. In cases of claiming damages from the insurer, an FIR for a motor accident is essential to avoid claim repudiation. Seeking guidance from an advocate specializing in Motor Accident Claim Tribunal Cases is advisable for proper steps and assistance.

A.Dear Client,
In the case of a road accident, it's advisable to report the incident to the police as soon as possible. While there may not be a strict time limit, filing a police report timely can help document the details of the accident and facilitate insurance claims if applicable. An FIR is typically required to be filed at the nearest police station to the location of the incident as soon as possible. otherwise, the accused takes the benefit of the doubt and the police will also not register your FIR easily ultimately you will have to take the shelter of Court u/s 156(3) of Cr. P.C. To claim damages arising out of a road accident from the Insurer, an FIR for a motor accident is a must, otherwise, your claim may be repudiated by the Insurer. Reach out to an Advocate handling Motor Accident Claim Tribunal Cases for guidance and steps.
