A.Dear Client,

Once a cybercrime scam or fraudulent transaction is reported online to the National Cyber Crime Reporting Portal (NCCRP), the investigating team, upon instruction from the Cyber Crime Cell, begins the routine process of investigation immediately. This may involve freezing the suspected accounts of fraudsters as well as the victim's bank account. During this time, the victim must wait for the investigation to be completed by the investigating agency.

The duration of the investigation of a cybercrime can vary significantly depending on factors such as the complexity of the case, the resources available to the investigators, and the cooperation of the victim.

Under Section 457 of the Criminal Procedure Code (CrPC), a Magistrate has the discretion to order the conditional release of the frozen amount in a cyber scam case. However, in such situations, the police may seek an indemnity bond from the victim. This bond requires the victim to declare that they will pay 1.5 times the refunded amount to the bank if their claim is found to be false or if other claims are made on the amount.
