Sir, since 1954 onwards Government of India settled Displaced Hardworking agricultural farmers (REFUGEE )into Andaman Islands and allotted agricultural landed property including Agriculture, Plantation & House site for their livelihoods. During 1954 to 1968 all refugees obtaining from Government Refugee reliefs such as: fooding, raw material, clothes, shelter & Cash of Rs.1700/ as a loan .
Now , the head of the family transfer the titles in favour of other party or sold any third party. Need to stop such type of title transfer of Government allotted landed property. If it is not protect or to stop to transfer property title, all the refugees may be landless in near future. Please guide.. Thanks

A.Dear Client,

According to Regulation 38(1) of The Andaman And Nicobar Islands Land Revenue And Land Reforms Regulation, 1966, all land in the Union territory belongs to the Government. No person can acquire property title or rights over the land except through a conveyance executed by the Government. Therefore, tenants cannot sell the land to a third party. To address this issue, grievances can be raised with the Land Revenue Department or the concerned Tehsildar. Additionally, filing a Public Interest Litigation (PIL) may help protect the interests of refugees affected by this unfair practice.

A.Dear Client,
According to Regulation 38. (1) of The Andaman And Nicobar Islands Land Revenue And Land Reforms Regulation, 1966, all land in the Union territory of the Andaman and Nicobar Islands is vested absolutely in the Government, and, save as provided by or under this Regulation, no person shall be deemed to have acquired any property title therein or any right to or over the same by occupation, prescription or conveyance or in any other manner whatsoever except by a conveyance executed by, or under the authority of, the Government. In view of the above provision of regulations, since all the land in the Union territory of the Andaman and Nicobar Islands is vested absolutely in the Government, the same cannot be sold by the tenant occupier to a third party. You can raise your grievance over the matter before the Land Revenue Deptt or Tehashilder concerned for a resolution in the matter. You can also consider filing a PIL on the subject to protect the interest of the refugees who are the victims of that unfair practice. Reach out to an Advocate handling PIL matters for guidance and steps.
