If someone has an error in his father's name in educational documents but it's rightly recorded in his birth certificate. Can an affidavit before a 1st class magistrate be accepted as a valid document to declare that the educational documents contain wrong and birth certificate contains the right one?? Can any organisation deny to accept an affidavit duly sworn before a 1st class Judicial magistrate???

A.Dear Client,

To legally change your name or surname, you need to follow a specific procedure. First, create an affidavit stating the facts of the name change, preferably sworn before a 1st class Judicial Magistrate or Executive Magistrate. Then, publish a notification in the Gazette of India and two local newspapers. Next, prepare a name/surname correction deed, including old and new name/surname details, on an appropriate stamp paper and notarize it with two witness signatures. Finally, submit the deed to relevant authorities for record rectification. Following this procedure ensures proper recognition of the name/surname change by the concerned authorities.

A.Dear Client,
An affidavit is a legal document that is used to state facts under oath. The affidavit should be made on a stamp paper of the appropriate value as per the state where the applicant resides and should be sworn preferably before the 1st class Judicial Magistrate or Executive Magistrate. Apart from the affidavit, you need to publish a notification in the Gazette of India. The Gazette of India is a publication of the Government of India that contains official government notifications, including name/surname correction/change notifications. The notification should be in the prescribed format and published in at least two local newspapers. After publishing the notification in the Gazette of India, the next step is to make out a name/surname correction/change deed. The said deed is a legal document that confirms the name/surname change and includes the details of the old and new name/surname. The deed should be made on a stamp paper of the appropriate value as per the state where the applicant resides and should be signed by two witnesses and notarized by a Notary Public. The final step is to submit the said deed of name/surname correction or change to the relevant authorities for information and rectification in their records. It is essential to follow the correct procedure to ensure that the name/surname change is recognized by the concerned Authority.
