I have filed cwjc 1162/2023 in patna high court notices served and counter affidavits submitted but since may 2023 not even date of hearing is given and nothing is moving forward, so many times my lawyer filed mention slips and applied for urgent hearing but court is not responding, what should I have to do now for urgent hearing and judgement?

A.Dear Client,
Speedy trial is a fundamental right implicit in the guarantee of life and personal liberty enshrined in Article 21 of the Constitution of India and any party to a litigation who is denied this right of speedy trial is entitled to approach the high court under Article 226 of the Constitution of India as well as Supreme Court under Article 32 of the Constitution of India for the purpose of enforcing such right. You can file a petition under Article 226 of the Constitution before the High Court praying for a direction to the court below wherein your case is pending for expeditious hearing of the case and disposal within a given time frame. Apart, you can put up an application before the trial Court praying for the transfer of your case to a Fast Track Court or Lok Adalat for a speedy trial by expressing the reasons/causes in the application. If the court does not allow your application, then, file a petition under Article 226 of the Constitution before the High Court praying for a direction to the court below wherein your case is pending for early hearing and disposal of a case which has been pending for long with no action.

A.Dear Client,
You can consult your lawyer to identify the reason for delay and enquire the ways to expedite the case. Visit the official website of the Patna High Court to know the status of the case. You can also contact the registrar or administrative officer of the high court to know the steps to be taken in order to address the issue. In case, your case is not being listed, then you can file a "listing application" and request to schedule your case for a early hearing.

A.Dear Sir,
Normally, many High Court not giving next dates. It is for the litigant who is in urgency must file an application through its advocate for taking his case on Board.
