Respected Sir/Madam,

Recently I had opted for work from home Online Data Entry Job opportunity as I am unemployed (located in Bangalore) and as per the Contract Signed on Rs. 20 Stamp Paper while taking up the job, it states "In the matter of non submission of the work or cancellation of work, the client is bound to pay the penalty amount of 6500 to the company\". I was unable to complete the work, but had ensured to submit whatever work had been completed before the due date and time. Now I had started receiving mails and calls asking me to pay the amount, if not legal action would be taken in Gujarat Court. Kindly share your views / opinion from the legal point of view for the above issue.

A.Dear Client, It appears that for lack of awareness and alertness, you put yourself in the glitch of a fraud Company that often takes advantage of employment crisis and allure the unemployed youth to extort money with ulterior motives. If you keep the details the identity of the company and a copy of said agreement with you then go through the same and if possible consult a legal professional to assess whether a condition of charging of fine in case of incorrect/inaccuracy response or dereliction in job. In case you find no terms as such in your offer letter then on receipt of such a threat from the Company demanding penalty or compensation, make a complaint against the Company at the local police station by way of GD and serve a legal notice to the said fraud company enclosing a copy of the police complaint(GD) informing them that you are contemplating filing a criminal suit against the Company for cheating and criminal intimidation u/s.415 and 503 of IPC. Section 73 of the Indian Contract Act, 1872 makes provision for unliquidated damages (not stipulated in a contract), Section 74 deals with liquidated damages (stipulated in a contract) and no compensation is attracted for mere breach of contract u/s.73. 74 of the Act unless such breach resulted in an actual loss or damage to the opposite party. Reach out to an Advocate for guidance and steps on receipt of any legal notice or court notice thereafter.

A.These data entry fraud cases are done by those companies which are fake and and they themselves are fraud and harass simple and common boys and girls from villages and small towns. You must know how to save yourself from these type of fraudsters and protect yourself.
First of whenever you get a job offer of these kind from an unknown company to do data entry do not accept that job as mostly they are fake jobs.
Secondly before accepting ask them to send a job offer letter and the company profile and website.
Ask them to send the company GST no. PAN no. CIN no and check the same online whether they are valid or not of they are not valid then just ignore and do not go ahead.
If suppose they threaten you then tell that you are going to file a police complaint and lodge an FIR against the data entry fraud company and then hopefully they should stop harassing you.
Never ever pay them any money whatever happens.


Data Entry fraud से कैसे बचे जानिये। सबसे पहल जब भी ऐसे किसी भी कंपनी से कॉल आये तोह स्वीकार न करे। काम लेने से पहले कंपनी के बारे में पूरी जानकारी इकठा करले की कंपनी सही है की नहीं। कंपनी का GST , PAN , CIN सब check कर ले और उसके बाद ही काम ले वरना न ले।
अगर कंपनी वाली आपको परेशान करते है या धमकी देते है तोह पुलिस को शिकायत करें मगर पैसे कभी भी न दे।

A.You have to take your stand clearly that you have completed the work.You have not stated what is the jurisdiction in contract clause, better to consult a Cyber specialist lawyer to guide & help you quickly.

A.We have dealt with many clients who have been trapped in this fraud. This company form Gujarat is a fraud company and you must raise a complaint in local cyber crime cell against it.
Don't pay any money to them and when they send you a legal notice you respond to them through your lawyer.
