403a accident case 403a accident case

I was travelling from madurai to bangalore in my bike. Near karur, i met with an accident. The old person who is trying to cross the road with bike, without seeing me he came on my way. He’s not wearing helmet because of that he got injured in head and result in dead after two days. So they put 403a section against me.

Now i got the bail. But in the internet i saw two years of prison or fine or both. Im so scared. Im working in an it firm. If they sentenced me in jail. My life will be questionable. Even though its not my fault.(he dint see me and cross the road)
Please advice what will be the punishment for this cause or else Will jury wii realease as not guilty

A.First of all it's not 403A but Section 304A under Indian Penal Code. Yes, if it is proved that you were driving rashly and negligently in that case you will be punished as per the law. What I would suggest you is to speak to a lawyer as soon as possible who can defend your case and prove that it was not your mistake but the deceased person's mistake then you can be saved.
