I got married 2014 and in 2015 a baby boy was born. My son is 4 years old. In last month my wife left my house with my son and messaged me by saying she is going to her Mother home. She is unwilling to come back now.
My question is. If I go to my in-laws home and bring my son than will it be considered a crime of kidnapping or abduction or any other consequences.

A.No crime but . Try to solve it amicable then not possible then you can file child custody suit

A.Dear client,
If you bring your son back to your home then it will not be called as kidnapping or abduction but this will cause hindrance in your case if you want to get custody of your son and file a suit for the same. It is advisable not to take any step for which later you have to face the consequences as the age of your son is 4 yrs old.
You can talk to your wife and try to settle it out or else file a suit for custody of your son.

A.Plz send her legal Notice for coming back with your Son n living together. If she doesn't return you will have to move legally for both the causes including custody of child or visiting to the child as he is only 4 years old
