i have filled a eviction case in delhi on my sister in law she filled a counter claim that she is real owner of that flat but lower court dismissed her claim and Honorable high court also dismissed her claim.
after that she filled that pass this case in Benami Tribunal Court under sec 65 because some payment done by her account which i return her and gave advance accordingly
so please suggest me

A.dear client in your case If one case is disposed off then the same case cannot be filed for the same thing in different court.
You can file a suit for stay order in the Tribunal stating the fact that she has caused false avertments before the court.

A.You have to contest the case before the Tribunal Court under sec 65, better to consult a professional property lawyer to guide & help you to protect your property & interest quickly.

A.Once the high court has refused to grant any relief seeking same relief under the garb of other provisions of law is abuse of process of law and can be quashed in appropriate proceedings. However what is the remedy exactly available to u can be known only after going through the petition filed by the other party.
