Sir, in a partition suit, in final decree proceedings under Order 26 Rule 13 and 14, can I file an IA (interlocutory application) under Order 26 Rule 14 to scrap the Report of the Advocate Commissioner? I already filed a Memorandum of Objections to the Report of Advocate Commissioner five months back. Written Arguments were also filed and arguments are in progress and will conclude soon. At this stage, is it maintainable to file an IA (interlocutory application) under Order 26 Rule 14 to scrap the Report? Essentially my question is: in final decree proceedings under Order 26 Rule 13 and 14, Memorandum of Objections were already filed and Written Arguments were also filed, and now can I file an IA (interlocutory application) under Order 26 Rule 14 to scrap the Report of the Advocate Commissioner?
