Who's the legal heir? Who's the legal heir?

My dad expired in 2005, intestate. He owned a house and some land, which was self acquired. We are 3 brothers and sisters. Mom is alive. In this situation, who is the legal heir of the property? I am asking because in recent times, a few of my friends have suggested that according to a new law, the mother (widow) assumes full rights to property. In case the property belongs to all the 4 survivors, how can we divide the property equally among us without selling it? Will my son & daughter have legal right as well?
