A. Dear Sir,
Yes, it is non bailable if Section 307 is included. Moreso, the judges and judiciary always see such offence as serious offence and may deny bail. However, get anticipatory bail before hand that is before arrest from Sessions Court or High Court.

Your first step should be to file for a divorce / judicial separation if you don't want a divorce. Adultery by husband is a valid ground for divorce. Since it is very hard to obtain direct evidence in a case pertaining to a cheating on a spouse, circumstantial evidence is sufficient.

yes, you can use this to support your claim. The letter can show that the relation you shared was cordial and the video footage from the CCTV may be used to support your claim that the case in hand was thought before hand and is a preplanned attempt. you can submit this as video evidence to the court.
