A. Hi,
While it is legal for HCL to have its own PF website, it is no longer mandatory for all employees to contribute to the Provident Fund. Employees with a basic salary of more than $15,000 have the option of opting out of PF, but only at the time of hire. Deductions from your PF account are largely dependent on Company Policy and your employment agreement, so any concrete legal recourse can only be provided after reviewing them.

I am working in IT company on third party role and in my offer letter there it is mentioned that employee should serve 2 months notice period on probation .Can any employer put these conditions in pr

A. Hi,
Since you signed the agreement, you must complete the notice period, even though you are on probation, because the corporation will normally demand money in the form of compensation from you. You may, however, refuse to work overtime or on weekends as soon as you resign and begin your notice period. After going through the agreement once, some other solution can be given.

Hey I live at my grandparents house with my parents and siblings . It's been more than 6 yrs since we moved at their place as due to my parents job we never stayed there . Now due to constant threat

A. Hi,
The grandfather can transfer the property to whoever he desires. A grandchild does not have any birth right in the self- acquired property of his grandfather. Domestic violence occurs when an act threatens or jeopardizes the victim's health, safety, or well-being (mental or physical), which involves physical, verbal, or emotional abuse. However, only your mother may request relief under the Protection of Women from Domestic Violence Act, 2005.

icon Marriage

Sir, my relative girl her college days she did registered marriage.. Later she leave that boy.. She didn't got divorce from him.. Now she married another boy.. Now she can register her new marriage?

A. Hi,
She cannot register the second marriage since it would be void as per S.27 of the Special Marriage Act, 1954 when there is already a living spouse. Further she would also attract punishments as u/S 494 and 495 of IPC.

icon Wanted to send a legal notice for recovering money for the services offered

I would like to send a legal notice to my client who had taken certain services but failed to make payment after the services was delivered.

A. Hi,
You can serve your client with a legal notice which should highlight your demand for unpaid fees and the costs arising. If he fails to comply with the legal notice then you may consider filing a suit for recovery before the court.

A. Recent High Court decisions suggest that he is not guilty of rape. And you can only complain to police, you cannot register FIR as suggested here.
