A. You can give the details of Mou clauses in divorce by mutual consent and can mark MOU as annexure of petition for divorce by mutual consent. In statement of parties the Mou can be get exhibited by both parties so of being part of judicial proceeding.

A. First of all, You have to understand legal procedure. Even if your brother has signed MOU with his wife and ready to settle down all matters you all have to go through with all legal proceeding. without chargesheet this 498-A criminal proceeding will not be closed. So let concerned police officer file Chargsheet then your case disposed off as early as possible if courts and witness support in this case. You cannot skip this legal procedure in order to close this matter.

You can divorce your wife by the pronouncement of specific words in case you are Shia and by the pronouncement of word talaq itself in the period of tuhr if you are Sunni. Still if there is any case then you need to prove the cost incurred to built the house and property maintenance. You can sell the property if the property has your name in its title deed.
