How to attach MOU to MCD so that MOU gets legally binded ? Can we include all clauses of MOU in MCD petition ?

A.You can give the details of Mou clauses in divorce by mutual consent and can mark MOU as annexure of petition for divorce by mutual consent. In statement of parties the Mou can be get exhibited by both parties so of being part of judicial proceeding.

A.MOU executed in court mediation center is only legal/
Any MoU executed before MCD is not legal binding.
Your lawyer will attach the MOU in the MCD petition directly.

A.First of all write down all terms and condition which you both agreed and file Mutual Consent Divorce petition mentioning all terms which you both agreed. Court will pass order accordingly and will be legally binding on both of you. in this case you you need not to execute MOU separately.

A.Hi,
Yes, you can include all clauses of MOU in MCD but attaching it will not make the MOU binding since safeguard will be provided in the petition only since MCD is the outcome of the settlement of all claims by either party.

A.Hi,
MOU has a psychological advantage and what you are including in MCD include it in MOU as well but it will not make it legally binding since your legal rights is only on the petition and you can question the terms of that alone.
