An adoption made without the consent of wife is void. If the consent of the wife living with the husband is taken but consent of wife living separately is not taken, the adoption is equally void.

Firstly, the father of the two children has to inform that a competent person can take the adoption of the children. He has to apply before the competent authority of the social welfare department after that social welfare department officially takes custody of the children and the District Judge is the competent authority to select the person/s, who can adopt the children according to law.
