A. Dear client, in my humble opinion you can sue the photographer for deficiency in service and unfair trade practice before a Consumer Court. You can demand compensation for the mental harassment caused due to the photographer's unprofessional behaviour. Since a significant portion of the fee for the project was paid in advance, you are the consumer and the photographer is liable to compensate for the difficulties incurred to you.

In case money is not refunded by the company you can send a legal notice demanding payment of full dues. In case it is not done then file a complaint in consumer forum for deficiency in service. Also you can register criminal complaint of cheating against the defaultors.
