icon offer letter contract clause- liquidated damage query

I got an offer letter from a company and it was written in the offer letter that "Upon acceptance of this Offer/Letter (“Contract”), should you fail or refuse to commence the performance of duties

A. Hi,
You have to abide by the terms of the contract. You can take any decision you like and the company can't force you to comply with the agreement. But they can sue you for the breach and ask for compensation.

A. Dear Sir,

It totally depends on the contract which you have entered into at the time of joining the company. If there is clause regarding the resignation that you will have to pay that amount of money to the company then you are bound as per the contract. But if there is nothing written that you have to pay that much amount of money then you have the right to go legally against the company. On talking about leaving the company, you can leave the company and they cannot make you stay. I will onl ...ReadMore

icon calculation of stamp duty for arbitration clause and indemnification clause

calculation of stamp duty for an agreement with arbitration clause and an indemnification clause

A. Hi,
How are stamp duty and registration costs computed in India? Stamp duty is generally 5-7 percent of the market value of the property. Typically, the registration cost is 1% of the property's market value. As a result, these charges may potentially amount to millions of rupees. When there is a violation of contract, the arbitration clause is enforced, and the indemnity clause is enforced.

A. Hi,
Section 12 of the Contract Act, which defines when a person is said to be of sound mind for entering into a contract, appears to imply, particularly under illustration (b), that intoxication can render a person incapable of making a contract; however, the drunkenness contemplated thereunder is of a severe variety. If he was willingly inebriated, the contract will not be deemed unlawful; but, if he was involuntarily or forcibly intoxicated, the deal will be considered a crime.

A. Hello Sir/Ma'am
You have entered into an Oral Agreement with your client and he is liable to pay if he/she has availed any services from you. You could file a suit for breach of Oral Contact under The Indian Contract Act. Oral contracts are generally considered as valid as written contracts, although this depends on the jurisdiction and, often, the type of contract. In some jurisdictions, some types of contracts must be written to be considered legally binding.

A. Hi,
Laws of Succession relate to legal principles of distribution of assets of a deceased individual. These include the order in which one person in preference of any or one person after another or any one person in particular share with any other person succeeds to the property/estate of the deceased person. All the people have equal shares and no person can take whole property until there is written in the will.

You are not liable to pay any amount to them as you have got the job on your own and not the job through them. Also contact a lawyer in case they send you a legal notice. Further information could be provided after getting through the agreement.
