Witness statement same as in charge sheet
Sir is it correct that in a trial court judge recorded witness statement same as in charge sheet including coma. Can I challenge this and quash such statements in HC.

A. Without seeing FIR, and what charges placed on you, your biometric proof may /may not be sufficient. If it is office, they will not only take Biometric, they take CCTV recordings and other information. That may be used in the actual Trial in criminal court. After FIR, Police do Investigation and then submit the report to Magistrate( Judge). Thumb access is prone to tampering, having limited value, may help.

A. Session Court has to cancel Anticipatory Bail after a petition by Police. Session court or HC can do this. Once this is done, Police can arrest. After Arrest, he can get Bail !!
Without Arrest, no requirement of 439. so Application is not even required
