I would like to know is there any way to appear one of the accused to not to appear in the court physically in criminal case for 313 statement . Total accused are 6 out of them last accused is unable

A. Dear Sir,
The law is not so matured. Actually there are any citations on this issue. The Trial Courts may split up the case against absconding accused and record your five accused persons 313 statement and pronounce its judgments. You may alternatively approach High Court for appropriate directions to the Trial Court.

Please contact any local advocate of Maharashtra residing in particular city where FIR is issued and ask him to get certified copy of FIR and to file anticipatory bail in Sessions Court and also if interested get file quashing petition before High Court and get a stay on such proceedings.
