icon Custody of my child taken illegally from my husband who has remarried.

i got divorced, and child custody is with ex husband , bot when he got second mary , i took my child back and keeping with me illegally , now need to know prons and causes would be if i kept my child

A. Hello
Aap ko aap ka husband child ka koi maintenance nhi de sakta hai. Kyon ki child aap ke husband ke pass hai. Aap apne liye maintenance ke liye case file kar sakte hai.
Sabse achha tarika hai ki aap child ki custody ke liye court me case file kare. Proper tarike se parapt kare.

A. Hello
In sabse aap proceeding me objection le sakte hai.
But maintenance lena ek alag procedure hai.
Jab divorce diya jaata hai tab ek settlement kiya jaata hai jiske liye husband ki or se ek must dhanrashi di jaati hai. Jo uske life maintenance ke liye hoti hai.
Isliye agar aap ke dawara usko aisi koi dhanrashi nhi di gai hai tab aap ko pay karni hogi.

A. If he has treated you in this fashion then you need to teach him a lesson too. You can either get this case converted to contested case or file a fresh case for contested divorce.
Additionally file a maintenance case for yourself and two daughters and let him feel the heat of two cases.

A. Dear Concerned,
Generally in mutual divorce, once the case is being admitted before court and next date is given which may be after six months , which would be for confirming for whether both couple are still for divorce or no other way to compromise . Then court proceeds for recording evidences thereafter court would fix the dat for order to pass as per evidences submitted by wife and husband. But sometimes court may require affidavit for Examination in chief before evidence. Find the law --- ...ReadMore

A. Dear client,
Sexual abstinence towards spouse is also a ground for divorce. You can file divorce petition on this ground. You have to prove his impotence. You can claim compensation from him also.

icon How to Withdraw from mutual consent

I had filed one sided divorce which got dismissed and mutual divorce was filed when my husband asked. He tried for reconciliation but I was not ready. Statements got recorded and next is counselling.

A. Aap apne advocate se contact kare unko sabhi baat bole ki ab me apni wife se divorce nhi lena chata hu. Aap apna statement kabhi bhi le sakte hai and court se bhi prayer kar sakte hai ki me wife ke sath rahana chata hu. Court aap ki prayer ko savikar kregi. Kyon ki court ka paryash bhi rahta hai ki married life ko surakshit kiya jae.
Jaida tension ki koi baat nhi hai.
