Yes, you both can claim maintenance and a right to reside permanently in the house property of your husband. Better file Domestic Violence case and claim protective order to stay in the same house and file another case claiming maintenance of 25% of your husband towards monthly maintenance out of his salary and other sources.

A. As your wife is not wiling to come to India for the divorce, you can seek permission of the Hon'ble Court to make the entire proceedings online. If the court permits for such proceedings, you can get the divorce by mutual consent through online hearing.

A. Divorce allowed by court only is valid and recognised. So giving divorce on stamp paper is of no value and marriage does not dissolved by writing on stamp paper. You and your husband can live seperately and independently in order to avoid day today fight and torture.

If your marriage is governed by the Hindu marriage laws, cruelty as a reason for divorce will not be deemed valid from the husband's perspective. You must pay alimony to her to cover her living expenses. The mother and you will have to agree on who will have custody of the child.
