A. If both of you want divorce then you can file Divorce on mutual consent to the Ld. Court. If your husband is not present in India or not wiling to come then you can seek permission of the Ld. Court for online proceedings, if ld court permits then you can get the divorce on mutual consent through online hearing.

You can file divorce on many grounds like non consummation of marriage, cruelty etc. You can even claim huge compensation for such cruelty and you have every liberty to file multiple cases like Domestic Violence case etc.

Yes, your friend's wife can create an accusation of an extramarital affair to add to the divorce clause, and she can also contact you. Your spouse may even consider this an adulterous affair if she asks you to testify.

A. The maintenance amount that is calculated is based upon the following factors:
Total monthly home income of both spouses without tax.
Educational background of both spouses.
The number of years of marriage.
Number of children and child custody.
As per the judgment passed by the Hon'ble Supreme Court, alimony amount should not exceed 25% of the husband’s income. The aforesaid limit is applicable in case of monthly payout.

A. Hi,
There's no compulsion for notice. now, you have to file a divorce case before the family court. if she doesn't appear, the proceedings will be ex parte. You have to approach the family court with a suit filed u/S 13.
