Is it mandatory to attend court if you received section 9 notice under Hindu marriage act? If yes what would be the procedure and how how much would a experienced lawyer would charge fees? If he has some 15-20years of experience?

A.Dear Sir,
It is not mandatory to attend the Court but if once it is decreed the movables of the judgment debtor may be attached. The fee differ from city to city and advocate to advocate depending upon their experience which may range between Rs. 25,000/- to Rs. 50,000/- further Rs.1,000/- to Rs.3,000/- on every court hearing date.

A.Hello
Yes it would be mandatory to attend the court if you receives a notice under section 9 of HMA. A legal notice under section 9 of the Hindu Marriage Act asks a spouse who has left the other without any reasonable excuse, to return. If you don't receive a reply to the legal notice regarding marriage problems under section 9, then the aggrieved party can approach the Court for restitution of conjugal rights.

Yes it is mandatory to appear beofre the court for notice served under section 9 of Hindu marriage act. The lawyer fee varies from different lawyer to lawyer it's not fixed. You could find lawyers from Rs. 10000 to Rs. 1 lacs.

A.Section 9 petition deals with the provision of restitution of conjugal rights, desertion is what they allege in it, once your spouse has a decree in section 9 he will have a ground for divorce, so you must attend it, simultaneously pursue other remedies vigorously. Lawyers are masters of their fees. Instead of going for lawyers fee, find the one who gives you time and helps you in making strategy. Take my services.

A.If you do not attend the court even after receiving notice an ex-parte order will be issued against you and your property may get attached in execution of the decree. the non compliance it would also afford a ground for divorce to your spouse. as far as the attendance of court is concerned it can be through an attorney who can apply for dispensing your personal appearance under the law which if the court grants which it usually does, then you will not be required to make any personal appearance unless it is the date of taking your cross examination. with regard to the fees of a lawyer it would depend on person to person basis and there is no settled fees structure that can be suggested. I usually charge taking into consideration the condition of the client and his or her paying capacity.
