My faced an accident while riding his bike having insurance. But DL on that date was expired & was again renewed later. But matter is that an old woman who suffered from a leg injury has filled a case to claim medical expenses. That woman has recovered from injury and can walk now. But what may be liability for my father and what may be the way to come out of liabilities ?

Sir, My brother died in Feb' 2002 in Road Motor accident, related MCOP case judgement came on 2008 with compensation of Rs.3,39,000/- with 9% compound interest; But Insurance company appealed in High court against order in the same year, But, in 2018 High court Verdict once again confirmed the lower Court order of compensation Rs.339000/- , BUT REVISION IN INTEREST RATE OF 7.5% COMPOUND INTEREST FROM PREVIOUS 9%. Sir, now my query is whether this revised Interest rate for onlycurrent year (present bank Repo rate period) or Throughout 16 years from the Date of case filling; My lawyer says for throughout 16 years, but another lawyer says " Bank interest rate will every year or half yearly or quarterly depending on RBI direction; But your amount was deposited in 2008 itself with 9% compound interest rate which was the prevailing bank rate in those period in Bank after Lower court Verdict; this amount accrued or multipled over the years with prevailing interest rates of each years; Your deposited amount is already multiplied, now you can't change the final figure; Only current year interest rate will be changed to 7.5% as per High court new order"...like that. Sir, I am very much confused now, which is correct? I spent a lot over the years with my time, work, patience & money, etc., If throughout the year is correct, is there any provision or option to appeal for regain previously ordered 9% interest rate? Is there any time limit for appealing? Should I appeal in High Court only or else can I appeal in Lower court itself where our previous order came? Please advice.. A. Dear Sir, Whenever there is confusion then file an application before the same Judge and to clarify the issue that is rate of interest. Always the insurance people take the benefit. Sir It is a very welcome step by NGT in its efforts to reduce pollution levels everywhere and specially NCR. Reducing vehicular pollution is also a part of it, but one thing I fail to understand the help it will get by banning of 10 years old diesel and 15 years old petrol vehicles. The age of car has no significant impact on pollution as to the period it has run. A taxi car may clock same mileage in 3 years and cause more pollution in balance years of its allowed life, which a private car may not have clocked in 15 years. By banning all vehicles without looking into the actual period run by them does not make much sense. Also, many of such vehicles need to have only their pollution causing element – the engine, replaced or rectified. My question is that if I replace a new diesel or petrol engine in my old diesel car ( which is over 10 years old and can not be used in Delhi NCR), which has got good chassis. Is there any provision available under MV Act to re- register such vehicles for a further period of 5/10/15 years further after engine replacement?

I have sell my bike but buyer has done cheating with me.i have sell letter , buyer purchasing affidavit & buyer adhar card. One cheating also done with me that buyer told me that his age is 19 & in purchasing affidavit he put his age 19.But after some days when I verify the buyer adhar card . Address & name match same as on adhar card but in adhar card buyer real age is 17.he has done editing on his age before purchasing & give me the editing Xerox adhar card. Totally buyer has done fraudgiri with me. Sir his acctual age is 17 . Is it is legally to sell bike to 17 years boy.when I was selling my bike he told me that he is 19 year. Buyer also put his age on purchasing affidavit that he is 19 years.Sir totally fraudgiri has done with me. Sir buyer not receiving my phone & not coming to transfer ownership name on bike RC. Sir totally I am going in depression ! Sir what should I have to do ! Kindly help me sir

A. Dear Client, As I understand there are several irregularities in this transaction. In order to save yourself first report the matter to the Police in writing . Selling a bike to the under age person is illegal and against the law o f the land. 2.He will also be caught for forgery/cheating etc. The other side of the story is if your vehicle is caught in some crime,rape, murder, accident which claims life, sex, drugs related issues you will be much trouble. 1. A load carrying 3 wheeler vehicle is registered in the name of my company 2. The vehicle meets with an accident where a) my driver who is a company employee, b) a helper who is contracted by the company and not a company employee and c) a third party commuter are killed. 3. The vehicle is insured, my company employee is insured. However contractor is not insured. In the above case what are the liabilities that my company will carry.

Sir, My car was affected by the recent Kerala floods and is declared as TOTAL LOSS by the insurance company . But they will be settling the claim on salvage loss basis only. So I have sold my car to a salvage buyer on the basis of Salvage quotations arrived by them The salvage buyer gives the amount quoted by him in cash and he gives a sale letter and proof of his id. Then the balance amount vof the IDV is settled by the insurance company . I have given signed Forms 29 & 30 to him and he says he will repair the vehicle and sell it . What should I do , if he doesn't do transfer of ownership within a reasonable period of say 90 days ?

My dad had been through an accident in the month of November 2017, Bike and car. petitioner has filed a case in tribunal for compensation on September 2018. Respondents being my dad and insurance company. Things is dad expired on February 2018 I.e months before the case was filed. Now they have included legal heir I.e wife and son into it. My question is do we need to pay compensation or insurance company will do the needful. Since the petitioner has included both legal and insurance jointly.
