Dear Sir, There is a case registered in front Motor accident claim tribunal between my husband and the petitioner. Here the petitioner knowing that the respondent is more has filed a case in the court making me(wife) and children’s as legal heirs as well as insurance company as respondents. Here vehicle had necessary and valid documents on the day of accident- like insurance, driving license and others. Now since my children work in Delhi and Bangalore, they won’t be able to attend the case. The reason we had created an Power of attorney that is children’s giving full rights to me(mother) for signing/ appearing and making necessary arrangements before the court. Here my question to you is I had bought a stamp paper as well as notarized it in Karnataka state but that is to be submitted in Kerala. Our permanent residence -Kerala, and presently live in Karnataka due to one of my child’s work purposes Question 2 if stamp value for POA low, can we input/ add special adhesive stamps to increase the stamp value on the General POA.

General Power attorney made in as well as notarized in Karnataka and to be submitted in Kerala mact court. - is it valid before the court - for appearing signing necessary documents before the court.( No financial dealing) - just children’s giving power to mother to execute. Here Respondent is no more, and wife as well children’s are legal heir wrt to the case - fully insured vehicle Permanent address -Kerala but residing in Karnataka Is Special adhesive stamps valid since there was shortage of stamp fee.

During my visit to jhansi a person hit my car and was injured i took him to the hospital in my car and paid his first aid Bill's but that person after 03 months filed a case against me in jhansi through court please tell me how to persuade the case I have received notice and my hearing is on 26 th april

Appear in the court Hire a local lawyer Fight out the case on merits also, [provide with the bills of the treatment] this will show that you did not intend to leave him on the streets and also did whatever was required at the time. my friend met with an accident recently as he was travelling in a car on a 4 laned highway at about 8pm. two guys on a motorcycle came in wrong route on curved road which resulted in the accident. the driver of the motorcycle died whereas the pillon rider suffered a fracture. It is obviously the fault of the biker but the chargesheet has not yet been made. How can my friend settle this case? please help.

I had a two-wheeler. Owing to some mechanical problems, I was neither able to drive it nor sell it. It was too costly to get it repaired. So, I sold it to a scrap dealer few years ago. He dismantled it in front of me, gave me a certificate of destruction ( With his signature on revenue stamp ) and his ID proof. I did NOT collect the chassis part out of ignorance ! I have original RC with me. It's registration is about to expire ! I would like to know if there is any way to cancel its registration in above-mentioned situation ? If no, What happens when you don't get your vehicle to RTA for re-registration after expiry.

Sir my friend gave me his car while proceeding on leave. He went on leave and few days later i met with an accident from his car. Nonone was injured as car went into the farms. Now my friend needs total money damage of his car. Car is not insured, its third party insured. Just guide me what i can do in this case. I have a driving license and I was also drunk at that time.

A. If you want to save your friendship, them try to settle the matter amicably with him. Otherwise he cannot approach any court of law for claiming the same from you. however, it is not advisable to drink and drive. Take care

A Boy Name "JAI " 12 Years old Yesterday on 21/03/2019 met with an Accident , car ran over the foot of the boy, the Person driving the car just said sorry and went . Boy was taken to municipal hospital Doctor advice for immediate X- Ray after the reports it was diagnosed fracture in his right foot , Also the wounds were bleeding on the elbow, hips and foot toes . Hence He was plastered on Right Leg. Also at the Same instance Child started Complaining about his feeling of Giddiness Vomiting and headache Doctor advised C T scan of head immediately, CT Scan was also done and the reports showed there are no major problems, but Medication are needed . As Doctor gave an option of taking him home but taking good care or Hospitalization. We discharged from hospital at night , now we want to lodge a police complain and file a Case Against for the accident and loss happened.

My faced an accident while riding his bike having insurance. But DL on that date was expired & was again renewed later. But matter is that an old woman who suffered from a leg injury has filled a case to claim medical expenses. That woman has recovered from injury and can walk now. But what may be liability for my father and what may be the way to come out of liabilities ?

Sir, My brother died in Feb' 2002 in Road Motor accident, related MCOP case judgement came on 2008 with compensation of Rs.3,39,000/- with 9% compound interest; But Insurance company appealed in High court against order in the same year, But, in 2018 High court Verdict once again confirmed the lower Court order of compensation Rs.339000/- , BUT REVISION IN INTEREST RATE OF 7.5% COMPOUND INTEREST FROM PREVIOUS 9%. Sir, now my query is whether this revised Interest rate for onlycurrent year (present bank Repo rate period) or Throughout 16 years from the Date of case filling; My lawyer says for throughout 16 years, but another lawyer says " Bank interest rate will every year or half yearly or quarterly depending on RBI direction; But your amount was deposited in 2008 itself with 9% compound interest rate which was the prevailing bank rate in those period in Bank after Lower court Verdict; this amount accrued or multipled over the years with prevailing interest rates of each years; Your deposited amount is already multiplied, now you can't change the final figure; Only current year interest rate will be changed to 7.5% as per High court new order"...like that. Sir, I am very much confused now, which is correct? I spent a lot over the years with my time, work, patience & money, etc., If throughout the year is correct, is there any provision or option to appeal for regain previously ordered 9% interest rate? Is there any time limit for appealing? Should I appeal in High Court only or else can I appeal in Lower court itself where our previous order came? Please advice.. Sir It is a very welcome step by NGT in its efforts to reduce pollution levels everywhere and specially NCR. Reducing vehicular pollution is also a part of it, but one thing I fail to understand the help it will get by banning of 10 years old diesel and 15 years old petrol vehicles. The age of car has no significant impact on pollution as to the period it has run. A taxi car may clock same mileage in 3 years and cause more pollution in balance years of its allowed life, which a private car may not have clocked in 15 years. By banning all vehicles without looking into the actual period run by them does not make much sense. Also, many of such vehicles need to have only their pollution causing element – the engine, replaced or rectified. My question is that if I replace a new diesel or petrol engine in my old diesel car ( which is over 10 years old and can not be used in Delhi NCR), which has got good chassis. Is there any provision available under MV Act to re- register such vehicles for a further period of 5/10/15 years further after engine replacement?
