A.Dear Client,
In motor accident cases both the owner and driver of the vehicle are liable to face prosecution proceedings initiated before the Motor Accident Claim Tribunal. In the given scenario, an application under Section 156(3) of Cr. PC can be filed before the Judicial Magistrate praying for the inclusion of the name of the driver who was driving the truck and found absconded after the accident who may then order the police to investigate the FIR impleading the name of the Driver. This time, the police cannot disregard or refuse to include the name of the accused driver in the FIR, which will trigger an investigation. To resolve the issue of demand for bribes by the police, you can file a complaint with the State Human Rights Commission or the State Police Complaint Authority, which are independent bodies empowered to investigate complaints against police officers. Reach out to an Advocate experienced in motor accident cases for guidance and steps.

A.Dear Client,
as per the master servant liability, if you were the one who had authorised your driver for the official work then there might be some liability on you as well. but only in case of the work assigned to him if he was deviated from the work you had assigned then you have no liability. File an FIR in the nearest police station and file a missing complaint. please contact a criminal lawyer handling motor vehicle case.
