A. In my humble suggestion, since there were three people on the bike, so it would amount to contributory negligence. Therefore, they won't be able to get compensation.

You need to find out the reason why the insurer is not allowing it and if the insurance for the vehicle is less than 5 years old and also if you have used can it twice during the policy tenure. If these are not the cases then you can send them a legal notice about how they are bound to pay or you will file a suit against them.
