The court should be informed of the death of OP and as per the order of the Court necessary steps to be taken by the Registry to find out the legal heirs/representative to continue the proceedings. If no heirs or representative of deceased OP is traceable, then the case may be heard exparte and order may be passed accordingly.

In plethora of cases Supreme Courts, High Courts have allowed the petition for specific performance filed under Specific Relief Act even in case of documents not registered under the Registration Act or any other Act applicable on the subject.
