If she is illegally encroaching on your property then you can file a suit demanding Injunction under Order 39 Rule (1) CPC. You can file a tittle suit if the construction is also made.

Remember when your mother expired then the self acquired property becomes a joint/ancestral property wherein all the legal heirs including your expired brother ( his lega heirs) get the right in the property. If their are more leva heirs then signing of the deed by few of them will not work and you need to get the signature of all the legal heirs if possible. The alternate way for you is to file a suit for declaration and basis that order of the suit get the rectification done.

As per the law once you have received the legal heir certificate then you need to apply for succession certificate at the court of proper jurisdiction. Once the court has issued the succession certificate then you can go ahead and get the property registered in your names.

For example a ground floor occupier may say that he does not need the lift and hence he will not pay the maintenance for the lift. For very conclusive answer you will have to seek the help of local lawyer or the land and revenue department of your state to understand the characteristics of the darkhast land.

When its a gated community then there is no provision for public road as gated community is supposed to be private property and the public are not supposed to use or come in unless approved by the host or the security. Send a legal notice to the landowner and the builder.
