A. Hi,
She can't claim the ownership right but she can claim for the adverse possession of the property. For the possession of a property, it is not necessary to be an owner of it. If she has been living there for many years, you can approach the court and get an order for her eviction.

A. Hello
As per the law your mother have equal share in your maternal grandfather's property as your uncle does. If your Nana has left a will and gave all the property to your uncle then you couldn't do much. But if not then your mother have equal share in the property and could claim the same.

If there is a clause in the sale agreement that if the buyer fails to pay the due amount in specified time then this agreement would he terminated or if the buyer does not fullfill the conditions of the agreement. In that case yout are legally permitted to cancel thr agreement and sell the property to someone else.

If the agreement registration has not been done yet then you'll have to pay the increased stamp duty. The amount paid to the builder for stamp duty and stilll not done would not make any exceptions. You'll have to pay the increased stamp duty.

A. Hello
You could have your part of your property by filing a partition suit in the civil court, but for that you'll have to come to India. Also you and your brother in law could mutually divide the land and get it registered by the court. Also it would be suggested to appoint a power of attorney for your properties in India to take care of them in case you don't frequently visits India.

Yes property on name of father can be sold as descendants. If you are the legal heir then you have all the right to sell the property to anyone after your father's death. For that you'll have to obtain an Succession Certificate from the court and mutate the property in your name then you could sell it to anyone in your name also.
