I have a 10 cent property in kerala which is in mine and my brother in law's name, I need to get my part of the property in order to do that what can be done?I reside in oman do i have to be there completely to do the partition?

A.Hello
You could have your part of your property by filing a partition suit in the civil court, but for that you'll have to come to India. Also you and your brother in law could mutually divide the land and get it registered by the court. Also it would be suggested to appoint a power of attorney for your properties in India to take care of them in case you don't frequently visits India.

A.Hello
You have all rights to claim all part of your property in India, as you are the co-owner of the property. To claim your part of your property you'll have to come to India and file a partition suit in the civil court. Also you could appoint someone trustworthy as the Power of Attorney for your property soo that he could act in your name in future.

A.Yes you have to come to India (Kerala) and file a partition suit with a help a of lawyer in a civil court. You could have elaborated little more that how you and your brother-in-law own the property then other ways than partition could have been explored.

A.Since you are a coowner of the property you have all the right to file a suit for partition of the property and take your part of the claim. Now before instituting this suit it is necessary to find out if your brother in law is ready to give you the share in your property without the court order which is also possible by mutual agreement. You can execute a general power of attorney to take care of the case in the court in India while you are away.
