A. A gifted property is your property, if the gift is registered deed. You can take action for partition either by partition deed with other co-sharers or by filing partition suit.

A. Nothing to worry. The limitation is 12 years. So also there are other grounds to resist. If they file suit for partition they have make checkers for minimum 3-4 years in one court. It is the wish of the mother and she can distribute as she wish as it was her amount.
