Dear law savers,
It is so kind of you,for your help guiding the people and I do have a query.
There was an accident happened 3 years back where FIR was filed stating rash driving/negligent etc. and I have paid the fine to court and took back my bike from police custody for which there was no fault of mine where the kid came all of a sudden into road while playing with his friends.now I hqve received a notice from high court where the injured is claiming for 15 lakh compensation for a very small damage of his leg statimg he is not able to play games.i contacted my insurance company and they said ok we take care and there is no need for me to appoint a lawyer as they have their own...and I still see the case status as pending with no hearing date.
My question is:
1. Do I have to appoint a lawyer?
2. If yes, the lawyer demanded 25k for the case where I'm financially poor and go to loss paying it.
3.if I have to attend court, I do not have financial help to appoint an attorney so will the insurance company lawyer help and how to contact the insurance company lawyer.
4. Will there be any impact for my future in career/profession?
5.how do I know that the insurance company is working on my case on my behalf (if insurance company lawyer takes care of my case)?
I expect your answer and help me so the law is saved.

A.you have not told what was the award/decree passed by the Tribunal/first court. In any case it is better to contest otherwise if insurance company put any adverse defense you will be held liable.

A.You need not to worry. There is possibility that the person has approached high court with a prayer to enhance compensation.
Answers:
1. Yes you need to appoint a lawyer.
2. You need not to hire a costly lawyer. You may engage a lawyer whose fees is comparatively low.
3. You are not required to attend the proceedings of court in MACT cases.

4. No, there will be no impact of this case on your career.
5. Insurance Company lawyer will not appear on your behalf. They will appear for themselves.

A.1. You should definitely appointment lawyer in your case.
2. You may appoint an advocate charging lower fees or may take help from Legal Service Authority in your district (you can inquire about it at district court), if you fullfill the parameters of getting a free legal help.
3. Insurance Company's Advocate will not help you, the interest of insurance company is against you.
4. Claim case will not have any effect on your future career/profession.
5. As I said you should not be dependent upon Insurance Company's Lawyer.
