Brother's wife has filed a false complaint against married sister and mentioned her name in the domestic violence case alongwith other family member's name (Boy, Younger brother, Mother). Can brother's married sister file a counter case against false complaint lodged by brother's wife. Married sister did not had a single word with the brother's wife since the last 12 months either via phone call or via sms/whatsapp/telegram. Relations of married sister with the brother's wife were absolutely fine prior to filing the false case. Marriage took place in May 2018. Brother's wife is presently not living with her in laws for the past 11 months. Brother's wife was mentally harassing boy's family at different instances while she was living with her in laws.

Please suggest with your recommendations as what can be done in such situation.

A.Hi,First of all don't be afraid if she (your sister) didn't do anything wrong. Would be better to Contact a lawyer for filing the quashing petition before high court to remove her name from the FIR.

A.1. first of all, ask her to file an application to delete her name from the case of domestic violence,
2. if name is not deleted, approach the concerned High Court by way of filing a writ petition to quash the proceedings against her,
3. once her name is stuck off, file a counter claim

A.Dear client
You can also file criminal and civil cases against her for false, maliciouse allegations, can proceed with defamation suit for reputation loss. You can include his relative names who are helping/persuading her for such maliciouse acts And many more
You can proceed with quashing of complaint at High court.

A.Yes she can file a counter claim when there is nothing to connect her with the actual domestic violence as stated by the wife.
