नमस्कार वकीक साहब बड़ी आशा लेकर आपके समक्ष उपस्थित हुआ हूं। समस्या ये है जून 2020 में मेरी दादी ने एक मकान जीतेजी मेरे नाम कर दिया है पॉवर ऑफ अटॉर्नी, गिफ्ट दीड, विल द्वारा लेकिन Lockdown के चलते मेरी आर्थिक स्थिति इतनी मजबूत नही है न ही दादी की ,की हम कागजों को स्टाम्प ड्यूटी पे करके रजिस्ट्री करवा सके। दादी की उम्र 92 वर्ष है अथवा उनकी देखभाल में ही करता हूँ । लेकिन उनका स्वास्थ्य दिन प्रतिदिन गिरता चला जा रहा है। दादी सर का एक ऑपरेशन भी हुआ है जिसमे सारा खर्च मेरा हुआ है। जो मकान मेरे नाम हुआ है उसमें मेरे ताऊ जी भी रहते है वो मुझे कब्जा नह लेने दे रहे। अगर मान लीजिये की में कोर्ट में केस भी करू तो क्या मेरे कागज़ जो मेरे नाम हुए है उनकी कानूनी मान्यता है बिना स्टाम्प ड्यूटी के अगर नही तो क्या कोई ऐसा रास्ता है कि बिना स्टाम्प ड्यूटी पे किये कागजो की कानूनी मान्यता पूरी तरह मजबूत की जा सके जैसे पक्की रजिस्ट्री की होती है क्योंकि वकील साहब मेरे पास बिल्कुल भी पैसे है स्टाम्प ड्यूटी पे करने के लिए। क्या कोई रास्ता है जिससे भगवान न करे दादी को कुछ हो जाये तो कागज़ बेकार न हो यानी उनकी कानूनी मान्यता बनि रहे स्टाम्प ड्यूटी पे किये बिना। ताकि कोर्ट में सामने वाले पक्ष द्वारा कागजों को चैलेंज न किया जा सके। में अपनी दादी और अपनी ओर से आपको हाथ जोडकर प्रार्थना करता हूँ कि कोई राह सुझाये

A.सामने वाला पक्ष हमेशा स्वतंत्र है आपकी रजिस्टर , वसीयत या पॉवर ऑफ atttoerny को कोर्ट में चैलेंज करने के लिए । अगर आप रजिस्ट्री भी करा लेंगे तो भी आपको कब्जा प्राप्त करने के लिए पुलिस या कोर्ट के पास जाना होगा । इसीलिए अपनी वसीयत को registeredकराए एवं डीएम , एसएसपी, आदि के पास कब्जा दिलाने की एप्लीकेशन लगाने की तैयारी रखें ।

A.gift deed of immovable property is compulsorily registrable whereas the Will is not required to be registered. Difference is that property can be transferred during life time of your Dadi through Gift Deed whereas Will be effected only after her demise. So Will is perfect document in your interest. However it can be challenged by your Uncle or any other relatives if they do not agree.

A.Most reliable way is to make registeration of gift deed and will , rate of registration of gift deed in blood relation is minimum rate . Do it fast save your property .

A.जो विल यानी वसीयत आपने अपनी दादी से अपने नाम पर करवाई है क्या वो रजिस्टर्ड है? यदि नहीं, तो उसे रजिस्टर्ड करवा लीजिये, बेहतर रहेगा,
ठीक है की आर्थिक परेशानी की वजह से आप रजिस्टर्ड डीड नहीं करवा सकते लेकिन करवा लेंगे तो बहुत बढ़िया रहेगा, हालाँकि रजिस्टर्ड वसीयत की भी वाही मान्यता है
