POLICE HAS LODGED FIR BUT NOT PUTTING UP CHALLAN IN COURT SINCE ONE YEAR AND FOUR MONTHS. MORE OVER DUE TO PRESURE OF OPPOSITE PARTY POLICE REMOVED 354 FROM FIR EVEN THOUGH WE HAVE PROOF/ EVIDENCE TO SHOW OUR SIDE. WHAT WE CAN DO IN THAT CASE

A.File an application for Calling of Status of the FIR at Concerned Ilaka magistrate. The investigation officer has to file the status report/ investigation progress report before the Magistrate.

You can file the application under section 156(3) of CrPc to add section 354 in the said FIR.

A.Dear Client,
As per your inputs the police is not filing chargesheet agains the accused, if you have all proper reasons then move to highcourt stating that the police is voluntarily not filing chargesheet and deleted section 354 IPC

A.You can make complaint to Magistrate if police is not submitting challenges.you can make prayer in complaint for adding 354.
