Transfer Of Rent Bill Not Done

One of our tenants is in possession of a room / flat after the previous tenant died and is claiming rights as a tenant for redevelopment to MBRR for transit accommodation . Can the landlords claim ownership for this room/flat and what legal steps should be taken in this regard.
