Hi
What is the procedure to make settlement in 420 case.
There are 3 people named in FIR. I am in different state.all have come to consensus to compromise. No chargesheet is filed yet.What is the procedure to do settlement from here.can I execute compromise deed without visiting that state.please explain

A.There are 2 options.
1 - it can be quashed by high court
2 - it can be allowed by magistrate court also.

It is better if you also make appearance in 2nd option so your signatures can be recorded in court records.

A.Along with settlement, the FIR will have to be be quashed by the High Court
So you will have to visit the jurisdictional High Court

A.Complaint can withdraw case from court after compromise. If court allows you all will be acquitted/discharged from case

A.You should appear alongwith the complainant before the comcerned magistrate court and file an application for permitting to compound the offence. Once permission is granted, court will aquitt you from the offence if only sec. 420 is levelled and no any other sections.
