Why do women wait to file a false 498a , DVC and maintenance case until husband files a divorce case? What is their strategy here? If she has left our home 8 months ago and more, how can she justify delay in reporting false case in front of police and judges? Is judiciary so stupid to believe such women?

A.Hi,
The Indian Judiciary have espoused a very strict mode to deal with such type of complaints of offences and deterrence has been also used by the Indian Judiciary to punish the convicts and to control such crime.
Moreover, only justified delay in filing of cases is accepted by the court.

A.Hi,
The Persons lodging false F.I.R are liable for the punishment under the following provision:
1.False Information under Section 182 of Indian Penal Code:
2.False Charge of offence made with intent to injure under Section 211 of I.P.C.
The courts apply the law, and settle disputes and punish law-breakers according to the law.

A.judiciary does not make law.
first learn who makes law.

Also, women who really suffer can not make mind to file cases.
I personally know many women who continue to suffer but not taking even free help.
Many came to our office for help but not took help and then continued to suffer.
there are multiple reasons....they dont have money for fees, they dont have guts, they are optimistic, they accepted fate, and some are are plain stupid.
