Dear Sir/Madam,

I am the younger son of my mother. I have one elder brother and elder sister. My mother passed away before 2 year. My mother has a property. Now her Legal heirs want to partition that property. Elder brother wants to have front side of the property. Because he is elder. Kindly tell me who will be eligible to take front side property as per law??

A.There is no fixed rule in law that which share/portion of property should be allotted to an heir. It may be looked into that which heir have been in possession of which particular. If there is no previous possession of front portion of your elder brother then he can not claim it as a matter of right. It will be be better if you all sought out the matter amicably.

A.After the perusal of the above facts and circumstances it is vital to assert herein that there is no law which says that elder will get the front portion as he is elder. The property shall be equally divided between the parties if the property is not in a position of equally divided, the same shall be sale and the consideration amount which you received shall be equally divided. Every legal heir is having right on the entire property whether it is front or back. Mutually you can agree for the same but not as having right of elder on the front side.
