Hi, I've been staying in a rental property for 4.5 years. The rental agreement was for 11 months since then it was not renewed. Now I gave 1 month notice for my landlord but he refuses to accept and asked me 2 whole months rent. But in the agreement it states that the tenant should give default notice before vacating the house. What is the default notice period? Can I claim it legally?

the notice has to be served for 21 days before you vacate the house.

A.Hi,
since the rent agreement was not renewed, you can easily vacate the house and you may serve a notice period.
the notice must be at lease 21 days in writing to end the tenancy unless the landlord agrees to a shorter time.
however the details provided by you are incomplete regarding any advance, amount of rent, etc.
please elaborate for better assistance.

A.Greetings,
we need an elaboration on the part of the rent agreement, however if the agreement was not renewed, and since you can serve one months' notice, the owner is ought to accept it.
if he does not you can send a legal notice to him.

A.Dear Sir,
You need not hand over keys of the house until he agrees to repay the advance by deducting one month rent only.

A.what were terms and conditions of only rent agreement for renewal.
atleast it has to mention that agreement auto renews after period of 11 months over.
what about rent, it is not increased after 1st year ?
if there is no rent agreement then anything can be deducted because you will not be in city to fight.
