Return of Gifts and Engagement ring after Engagement is called off Return of Gifts and Engagement ring after Engagement is called off

My Engagement was called off after 20 days of the same as the groom side was asking for us to take permission for 200 Baratis that was impossible due to government guidelines in Covid. They called off the engagement and since then it has been 6 moths we are following up with them for return of Gifts and 2 Lakh cash that we gave for the arrangement of the engagement as his father is no more, so his mother asked that it is in relation and they need it for engagement arrangement. From last couple of days he has blocked our nos and his mother has switched off her phone. He is working in reputed Japanese MNC as HR in Faridabad. We are ready to return all the Shagun and engagement ring the same day they return us our Gifts, Shagun and Engagement ring.

Pl guide me as I have an ailing father admitted in hospital and we are undergoing financial stress and this 2 lakh amounts huge for us.

A.Hi,
Since it was a form of contact which has been revoked but you have incurred damages. you have to return all the boys side articles and you must keep in mind that since he has broken the engagement so you can also claim damages from them which you have incurred on engagement ceremony, your shopping for marriage and booking of hotels which you have paid /advances, you can also claim mental harassment charges; but for all these things they have to prove that engagement is broken from his side without any fault of girl and her family.\

you can send a legal notice initially and later file a suit.

you can send them the legal notice for the same. it seems they are unwilling to return the amount, you can later file a case under- fraud, criminal breach of trust, cheating fraud,. you can even charge interest on the amount you gave them.
